Summary:
The accused was charged and convicted of possession of heroin for the purpose of trafficking. The accused appealed to the Quebec Court of Appeal.
The Quebec Court of Appeal dismissed the appeal. The accused appealed to the Supreme Court of Canada.
The Supreme Court of Canada allowed the appeal and ordered a new trial on the ground that the trial judge failed to follow the special procedure in s. 8 of the Narcotic Control Act.

Procedure - Waiver - The Supreme Court of Canada stated that a party may waive a procedural requirement enacted for his benefit - However, a judge may require compliance with a procedural requirement notwithstanding a desire to waive the requirement (see paragraph 13).
