Summary:

The accused pled guilty to one count of possession of child pornography and one count of making available child pornography.

The Saskatchewan Court of Queen's Bench sentenced the accused to two years for the possession of child pornography charge and one year concurrent for the charge of making child pornography available, followed by three years of probation. The court also made the following ancillary orders: a DNA order, an order requiring the accused to comply with the Sex Offender Information Registration Act for life, a forfeiture order pursuant to s. 490.1 of the Criminal Code, a prohibition order pursuant to s. 161(1) of the Code for a period of 20 years, and a $100 victim surcharge.

Sentence - Manufacture, distribution or possession of obscene matter (incl. child pornography) - The accused pled guilty to one count of possession of child pornography and one count of making available child pornography - The Crown stated that the police found 152,814 images of child pornography and 6,219 videos of child pornography in the accused's possession - The Crown indicated that there still remained a vast number of images, videos and CDs that had yet to be categorized - The images and videos that had been categorized as child pornography depicted sexual acts with children of all ages, including infants and of both sexes, and every type of sexual assault - The accused was 44 years of age - He received a suspended sentence in 1994 for a break, enter and theft and was convicted in 2007 for uttering a forged document - The Saskatchewan Court of Queen's Bench imposed two years for the possession of child pornography charge and one year concurrent for the charge of making child pornography available, followed by three years of probation - The court made the following ancillary orders: a DNA order, an order requiring the accused to comply with the Sex Offender Information Registration Act for life, a forfeiture order pursuant to s. 490.1 of the Criminal Code, a 20 year prohibition order pursuant to s. 161(1) of the Code, and a $100 victim surcharge - The aggravating factors included the size of the collection and the length of time in which the accused was engaged in this pursuit.
