The 28-year old accused pled guilty to invitation to sexual touching contrary to s. 152 of the Criminal Code, sexual assault contrary to s. 271(1)(a) of the Code, and making of child pornography contrary to s. 163.1(2)(a) of the Code. The victim was a 10-year old girl.

The New Brunswick Provincial Court sentenced the accused to 18 months' imprisonment for making child pornography, 8 months' imprisonment (consecutive) for sexual assault, and 4 months' imprisonment (consecutive) for invitation to sexual touching.

Sentence - Manufacture, distribution or possession of obscene matter (incl. child pornography) - The 28-year old accused pled guilty to invitation to sexual touching, sexual assault, and making child pornography - The victim was a 10-year old girl - The accused was a family friend and the girl's babysitter - The offences took place over a period of seven weeks - The girl reported that the accused had entered her bedroom, grabbed her wrist and tried to have her touch his penis - She also reported that he had taken nude photographs of her and touched her vaginal area with his hands - Police seized the accused's android phone and found 589 child pornography photos featuring the girl - There were also 44 grooming and posing photos - The photos showed the girl lying nude on her bed and in the bathtub, close-ups of her vaginal area, the accused's bare penis pressed against her vaginal area, and close-ups of the girl urinating and defecating in the bathroom - The accused had no prior criminal record - The New Brunswick Provincial Court sentenced the accused to a total of two and a half years' imprisonment, assigned as follows: 18 months for making child pornography, 8 months (consecutive) for sexual assault, and 4 months (consecutive) for invitation to sexual touching.
