Résumé:
The accused, on behalf of his small contracting company, entered into a fixed-price contract to build a new home for the complainants, who already owned the lot on which the home would be built. In connection with that project, the accused was charged with four specific counts of criminal fraud. The accused denied any criminal conduct, alleging that any issues between him and the complainants should be resolved through civil litigation.
The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported at 396 N.B.R.(2d) 96; 1024 A.P.R. 96, acquitted the accused of three counts and convicted him of one count.
The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported at 399 N.B.R.(2d) 388; 1035 A.P.R. 388, sentenced the accused to one year of probation. The Crown appealed the accused's acquittal on the first count.
The New Brunswick Court of Appeal dismissed the appeal.

Fraudulent transactions - Fraud - What constitutes fraud - The accused, on behalf of his small contracting company, entered into a fixed-price contract to build a new home for the complainants, who already owned the lot on which the home would be built - In connection with that project, the accused was charged with four specific counts of criminal fraud - The Queen's Bench trial judge acquitted the accused of fraud by failing to register the home under the New Home Warranty Program - Such warranty could be arranged up until the completion of construction - When the complainants asked the accused about that warranty protection before they released a progress payment to him, he responded in a letter - The judge held that what the accused wrote in the letter concerning the registration of the home under the Atlantic Home Warranty Program could be summarized as indicating that he had optimistic intentions - The judge was not persuaded beyond a reasonable doubt that the accused was fraudulently dishonest regarding that registration - The Attorney General appealed the acquittal on this count - The New Brunswick Court of Appeal dismissed the appeal - Section 676(1)(a) of the Criminal Code limited appeals by the Attorney General against verdicts of acquittal to questions of law alone - The judge's determination that the alleged fraud was not proven beyond a reasonable doubt was a finding of fact - That finding might have been incorrect but, if that were the case, the error would be one of fact, not law.
