Summary:
The accused was convicted of harassment and sentenced to a 12 month recognizance. The recognizance had six conditions. The accused appealed, seeking an order dismissing the ruling that the complainant had reasonable grounds to fear him. Alternatively, he sought to vary the second and sixth conditions of the recognizance to permit limited contact with the complainant. The accused also filed a notice under the Constitutional Questions Act. The appeal was dismissed. The accused sought leave to appeal. He also asserted that he had an appeal as of right from the decision to deny his application to raise a constitutional question. The Crown applied to strike or quash those parts of the notice of appeal and application for leave to appeal the constitutional question issue.
The British Columbia Court of Appeal, per Kirkpatrick, J.A., dismissed the accused's application and allowed the Crown's application.
