Summary:
The accused's vehicle was pulled over for speeding. The officer detected an "overwhelming smell of marijuana" coming from inside the vehicle. On the basis of the odour, the officer concluded that he had reasonable and probable grounds to arrest the accused and search the vehicle. The accused was convicted of possession of marijuana for the purpose of trafficking. He appealed from the conviction, asserting that the arrest was unlawful.
The British Columbia Court of Appeal dismissed the appeal.
