Summary:

The accused pleaded guilty to break and enter and failing to appear for sentencing.

The Nova Scotia Provincial Court sentenced the accused to 50 months' imprisonment for break and enter and three months (consecutive) for failing to appear for sentencing.

Sentence - Break and enter - The 18 year old accused and another person flew from Alberta to Nova Scotia to rob the victim, believing there was a safe holding $50,000 - Although the robbery was planned when the home was vacant, the 78 year old female victim was home - The victim was confined in her bedroom - No weapons, violence or threats of violence were used and the accused and the other person did not attempt to disguise their identities - They spent 20 minutes unsuccessfully attempting to open the safe, then left in the victim's vehicle with the safe and money from the victim's purse - The vehicle was damaged, the victim's phone was destroyed and the victim was traumatized - The accused was apprehended later that day - After pleading guilty to robbery, the accused was permitted to return home to Alberta pending sentencing - The accused failed to appear for sentencing and fled to California for some time - He was arrested upon his return to Alberta - The accused was remorseful - The Crown sought a sentence of seven years' imprisonment - The accused submitted that 2-2.5 years was appropriate - The other offender, who was the "leader", had been sentenced to six years' imprisonment less credit for remand time - The accused, unlike the other offender, had no prior criminal record - After credit for remand time, the Nova Scotia Provincial Court sentenced the accused to 50 months' imprisonment for break and enter and three months (consecutive) for failing to appear for sentencing - See paragraphs 1 to 30.
