Summary:

The accused was convicted of possession of cannabis marihuana for the purpose of trafficking contrary to s. 4(2) of the Narcotic Control Act. The trial judge fined the accused $300.00 and imposed two years' probation. The Crown appealed against sentence.

The Saskatchewan Court of Appeal allowed the appeal, set aside the sentence and substituted a term of six months' imprisonment. Vancise, J.A., dissenting in the result, would have allowed the appeal but would have imposed a sentence of 60 days' imprisonment plus one year's probation with 100 hours of community service work.
