Summary:

The accused pleaded guilty to possession of stolen property, contrary to s. 394(1)(c)(iii) of the Criminal Code. Particularly, the accused had in his possession gold ore with a total value of $79,745.

The Ontario Court, General Division, sentenced the accused to seven months in an Ontario Correctional Centre. The court declined to allow the accused to serve the sentence in the community stating that to allow a non-custodial sentence would not discourage like minded people in the community from committing a similar offence.
