Summary:

The accused pleaded guilty to fraud under $5,000 (Criminal Code, s. 380(1)(b)) and was sentenced to a suspended sentence plus two years' probation. The accused appealed the sentence.

The Nova Scotia Supreme Court allowed the appeal, set aside the conviction and substituted a conditional discharge.

Procedure - Verdicts, discharges and dis­missals - Conditional discharge in lieu of conviction - The accused pharmacist, whose licence had lapsed, fraudulently held himself out to be a licensed pharmacist to obtain Dilaudid tablets from another phar­macy for personal use - The accused pleaded guilty to fraud and was given a suspended sentence plus two years' pro­bation - The accused appealed the sentence - The accused had a drug and alcohol addiction, which he was successfully treat­ing - No criminal record - The Crown and accused had jointly recommended a con­ditional discharge, which the sentencing judge rejected as not in the public interest - The judge also stated that the accused failed to prove an intention to continue his profession and that a conviction would preclude that - The accused subsequently applied for readmission to the N.S. Phar­maceutical Society and it was uncertain whether his conviction would preclude readmission - The Nova Scotia Supreme Court held that the judge erred in finding that general deterrence, because the accused was a pharmacist, would not be met with a conditional discharge - The court held that general deterrence, which was overemphasized by the judge, could be met by substituting a conditional discharge with the condition that the accused give 12 one hour lectures to students on the conse­quences of alcohol and drug abuse.
