(Suit No. 360/89)

Indexed As: R. v. Mohammed (F.)

Manitoba Court of Appeal

Twaddle, Lyon and Helper, JJ.A.

November 21, 1989.

Summary:

The accused was convicted of possession of a weapon dangerous to the public peace and of aggravated assault. He was sentenced to concurrent terms of imprisonment. After the 30 day appeal period expired the Crown applied for an extension of time for filing an application for leave to appeal. The chambers judge granted the application in a judgment reported 60 Man.R.(2d) 283. The accused appealed.

The Manitoba Court of Appeal dismissed the appeal after reviewing the principles governing the extension of time for applying for leave to appeal.

Criminal Law - Topic 4909

Appeals - Indictable offences - Procedure - Application for leave to appeal - Time for - Extension of time - The Manitoba Court of Appeal affirmed a chambers judge's extension of time for filing a Crown application for leave to appeal from sentence, notwithstanding that the affidavits in support were defective in form - The court found that the evidence was sufficient to enable the chambers judge to find that the Crown had formed an intention to appeal in time and that the explanation for the delay was reasonable - The court stated that the discretion of the court on such applications was free and unfettered, but set out various criteria which may be considered, if pertinent.
