Summary:
The accused was convicted of possession of a weapon dangerous to the public peace and of aggravated assault. He was sentenced to concurrent terms of imprisonment. After the 30 day appeal period expired the Crown applied for an extension of time for filing an application for leave to appeal. The chambers judge granted the application in a judgment reported 60 Man.R.(2d) 283. The accused appealed.
The Manitoba Court of Appeal dismissed the appeal after reviewing the principles governing the extension of time for applying for leave to appeal.
