Summary:

The accused were charged with conspiracy to procure the miscarriage of female persons. The trial judge, sitting with a jury, acquitted the accused. The Crown appealed.

The Ontario Court of Appeal allowed the appeal, set aside the verdict of acquittal and ordered a new trial.
