The Crown applied under s. 9(1) of the Juvenile Delinquents Act, R.S.C. 1970, c. J-3, to have a juvenile proceeded against by way of indictment in the ordinary courts. The Alberta Provincial Court, Juvenile Division, dismissed the application.

Juveniles - Transfer out of Juvenile Court - Considerations - For good of child or community - A juvenile was charged with attempted murder and with possession of a weapon for a dangerous purpose - The juvenile did not have a previous record or history of abnormal behaviour - The Alberta Provincial Court, Juvenile Division, held that it was for the good of the child and the community that he should be tried under the juvenile judicial system, because the best treatment that could be provided to the juvenile was under the juvenile judicial system - See paragraphs 23 to 31.
