Summary:

The accused young offender was picked up by police for impaired driving and was advised of her right to counsel. Prior to giving the second breath sample, the accused requested to speak to her brother, who was at the police station. The request was denied. A Provincial Court judge held that there had been a breach of the accused's s. 10(b) Charter right and excluded the evi­dence from the second breathalyzer test and dis­missed the charge. The Crown appealed.

The Saskatchewan Court of Queen's Bench dismissed the appeal.
