Punishments (sentence) - Prohibition orders - Respecting contact with victims - A commentator discussed the need for "no-contact" orders prohibiting contact by offenders with their victims - The present Criminal Code and proposed amendments (Bill C-41) do not adequately protect ascertained victims - Unlike a s. 100 firearms prohibition order, "no-contact" orders can only be imposed under s. 737(2)(h) as a condition of probation - Since probation can only be imposed for sentences less than two years' imprison­ment, a trial judge is limited in protecting crime victims from contact with the offender - The commentator discussed the desirability of a legislative amendment providing for a s. 100 style "no-contact" order not dependent upon the availability or desirability of a probation order - (Ontario Court of Justice, Provincial Division).
