Summary:
The accused was convicted on two counts of sexual assault and was sentenced to four years' imprisonment. The accused appealed his convictions and applied under s. 679(3) of the Criminal Code for judicial interim release pending the hearing of the appeal.
The Alberta Court of Appeal, per Berger, J.A., allowed the application and granted the accused's release subject to conditions.
