Summary:

The accused were acquitted of possessing a portion of a deer carcass contrary to s. 58 of the Fish and Wildlife Act. The Crown appealed.

The New Brunswick Court of Queen's Bench, Trial Division, in a judgment not reported in this series of reports, dismissed the appeal. The Crown appealed.

The New Brunswick Court of Appeal, Ryan, J.A., dissenting, allowed the appeal and ordered a new trial.

Fish and Game - Topic 801

Indian, Inuit and Métis rights - Right to hunt off reserves - The New Brunswick Court of Appeal stated that the 1725 Treaty of Boston did not grant Maliseet Indians in New Brunswick an unrestricted right to hunt anywhere, at any time and in any manner - The court stated that a trial judge must determine whether the treaty right, based on the evidence, was exercised safely - See paragraphs 1 to 21.
