Summary:

The unrepresented accused was convicted of assault causing bodily harm. A date was set for sentencing submissions. The accused appeared with counsel and applied for a mistrial pursuant to s. 24 of the Charter on the grounds that he was not advised of his right to receive disclosure and never received any disclosure. The Crown argued that Promise to Appear and Undertaking forms which had been given to the accused contained notices of his right to disclosure and that the accused's conduct by not requesting disclosure constituted a waiver.

The Alberta Provincial Court found that there had been a violation of the accused's s. 7 Charter right to a fair trial. The court declared a mistrial and ordered a new trial.
