Offences - Sentences, fines and penalties - Breach of enforcement order or approval - The accused company operated a potash mine - A rupture occurred in a brine pipe­line and brine leaked into a nearby stream - The leak was discovered quickly, report­ed and repaired - There was minimal envi­ron­mental damage - The company pleaded guilty to failing to comply with the term or condition of a certificate of approval to operate, contrary to s. 33(1)(b) of the Clean Environment Act - The rupture occurred through no fault of the company which had been diligent in monitoring - Following the incident, the company took steps to increase their vigilance - The company agreed to pay $3,000 to a local conservation association - The New Bruns­wick Provincial Court accepted a joint submission on sentence and imposed the minimum fine of $1,000.
