Sentence - Manslaughter - The accused's fiancée left him because of his drinking habits - Hours later, the accused talked her in returning home - Soon after, he shot her in the stomach with a shotgun - There was no provocation - He did not try to help her - He left for beer, returned, consumed three and changed from his bloody shirt into an identical clean one - One hour after the shooting he called 911 and reported that his fiancée had committed suicide - Later, he alleged that the shot was fired by accident as he was trying to unload the gun - A jury found him not guilty of second degree murder but convicted him of man­slaughter - The accused (35 years old) was an experienced hunter - Strong supportive family - Worked most his life - No violent offences - Favourable pre-sentence report - Good candidate for rehabilitation - Had a son who he supported financially - The New Brunswick Court of Queen's Bench, Trial Division, stated that this was a clear case of domestic violence - The court sentenced the accused to nine years' im­prisonment with a lifetime firearms prohib­ition.
