Summary:

The accused was charged with attempted murder, aggravated sexual assault, unlawful confinement, breaking and entering a dwelling house and committing aggravated sexual assault, and using a weapon in committing a sexual assault. The accused applied for an order that the Legal Aid Society of Alberta or Her Majesty The Queen be directed to pay the expenses for report preparation and court appearances for Dr. Semrau, a forensic psychiatric expert. The accused invoked ss. 7, 11(d) and 24(1) of the Charter, arguing that the order sought was necessary for the accused to make full answer and defence and have a fair trial. The accused had qualified for the appointment of counsel through the Legal Aid Society, but the Society denied a request to fund an assessment and report by Dr. Semrau.

The Alberta Court of Queen's Bench held that the Legal Aid Society had been improperly joined to the matter and it was removed as a party and no order would be made against it. The court concluded that the psychiatric investigation sought was necessary to ensure the accused a fair trial and that the Crown should defray the cost of that investigation. The court directed that unless the Crown made arrangements to guarantee the payment of Dr. Semrau's account by September 15, 2006, the prosecution of the accused would be conditionally stayed on September 18, 2006, pending the Crown taking that step. The court's order was limited to an investigation of the accused's case by Dr. Semrau and his provision of a report to the accused's counsel. The court retained jurisdiction to consider whether the Crown should be required to defray the further cost of Dr. Semrau's attendance as a witness.
