Summary:

A 17 year old youth charged in adult court on charges of attempted murder, robbery and breach of probation pleaded guilty to aggra­vated assault. The youth shot a cab driver in the back of the head. The cab driver sur­vived, but had a bullet lodged in his brain and was blind.

The Nova Scotia Provincial Court sen­tenced the youth to imprisonment for seven years and nine months.

Sentence - Aggravated assault - A 17 year old youth shot a taxi driver in the back of the head, stole his money and left him to die - The driver survived, but is now blind - The youth knew the driver - The youth was a drug trafficker with an exten­sive criminal record for drug offences, being unlawfully at large, uttering threats and assault - The youth was on probation at the time of the offence - The Nova Scotia Provincial Court held that the start­ing point sentence was between five and 10 years; that the act of senseless violence required denunciation and condemnation - The court, after giving the youth 15 months' credit for 10 months spent on remand, sentenced him to imprisonment for seven years and nine months - The court stated that "young persons who com­mit these types of crimes should know that their age will not save them from appro­priate and lengthy sentences".
