A young offender appealed a sentence of 30 months' secure custody for robbery.

The Manitoba Court of Appeal allowed the appeal and substituted a sentence of 24 months' secure custody.

Young offenders - Decisions (incl. pun­ishments) - Sentencing considerations - A young offender appealed a sentence of 30 months' secure custody for robbery - The offence was serious, premeditated, com­mitted by a gang, involved weapons and violence - The Manitoba Court of Appeal stated that "[i]n sentencing an offender for an offence such as this, public protection is paramount ... not only from an unwar­ranted attack, but also from the fear of it. ... Although deterrence to others is less of a goal in the case of a young of­fender, it remains a factor in a group crime such as this. ... A lengthy term of secure custody is therefore in order" - See para­graphs 17 to 26.

Young offenders - Decisions (incl. pun­ishments) - Secure custody - A young offender appealed a sentence of 30 months' secure custody for robbery - He and a companion viciously beat the victim in order to steal a skate board - A probation officer testified that the young offender stated that the victim's serious injuries were his own fault, because he should have given up his skate board - The young offender denied making the state­ment - The Manitoba Court of Appeal stated that the Youth Court judge erred in finding that the young offender had made the statement and in considering it in deciding the sentence, because the Crown is required to prove any aggravating fac­tors that are to be considered in sentencing - The court reduced the sentence to 24 months' secure custody.
