Summary:
The accused was convicted by a jury of causing bodily harm to a woman he lived with while he sexually assaulted her contrary to s. 272(1)(c) of the Criminal Code. The accused was sentenced to 36 months' imprisonment. The Crown applied for leave to appeal the sentence.
The New Brunswick Court of Appeal granted leave to appeal, allowed the appeal and increased the sentence to six years.

Sentence - Sexual assault with weapon, threats to third party or causing bodily harm - The accused was convicted by a jury of causing bodily harm to a woman while he sexually assaulted her - The couple had been living together as man and wife for approximately three months - The crime involved a "... prolonged and vicious sexual assault which included acts of cruelty and sadism ..." - The assault included nonconsensual intercourse - The victim suffered physical injuries and psychological trauma - The accused had 23 prior convictions, including narcotics offences, theft, break and enter, uttering death threats, possession of an offensive weapon etc. - The accused was sentenced to 36 months' imprisonment - The New Brunswick Court of Appeal increased the sentence to six years' imprisonment.
