Summary:

The accused was convicted by a jury of causing bodily harm to a woman he lived with while he sexually assaulted her contrary to s. 272(1)(c) of the Criminal Code. The accused was sentenced to 36 months' im­prisonment. The Crown applied for leave to appeal the sentence.

The New Brunswick Court of Appeal granted leave to appeal, allowed the appeal and increased the sentence to six years.

Sentence - Sexual assault with weapon, threats to third party or causing bodily harm - The accused was convicted by a jury of causing bodily harm to a woman while he sexually assaulted her - The couple had been living together as man and wife for approximately three months - The crime involved a "... prolonged and vicious sexual assault which included acts of cruelty and sadism ..." - The assault included nonconsensual intercourse - The victim suffered physical injuries and psy­chological trauma - The accused had 23 prior convictions, including narcotics of­fences, theft, break and enter, uttering death threats, possession of an offensive weapon etc. - The accused was sentenced to 36 months' imprisonment - The New Brunswick Court of Appeal increased the sentence to six years' imprisonment.
