Summary:
The New Brunswick Provincial Court imposed a conditional sentence of 18 months' imprisonment on an accused convicted of sexually assaulting a three year old girl. The Crown applied for leave to appeal.
The New Brunswick Court of Appeal granted leave to appeal and allowed the appeal. The Court sentenced the accused to 18 months' imprisonment.

Sentencing - Appeals - Variation of sentence - Grounds for varying sentence imposed by trial judge - The trial judge imposed a conditional sentence of 18 months' imprisonment on an accused convicted of sexually assaulting a three year old girl - The New Brunswick Court of Appeal substituted a sentence of 18 months' imprisonment - The court held that the judge had committed an error in principle by not including in the sentence, conditions restricting the accused's freedom. Furthermore, in failing to punish the accused and in not denouncing his unlawful conduct, the sentence at trial undermined public confidence in the administration of justice - The sentence was not proportionate to the seriousness of the offence, did not take deterrence into account and was a substantial departure from sentences imposed in similar cases.
