Summary:
An accused pleaded guilty to dangerous driving causing bodily harm. At issue was whether a conditional sentence was appropriate.
The Alberta Provincial Court imposed a nine month conditional sentence.

Punishments (sentence) - Conditional sentence - When available or appropriate - The 19 year old accused drove too quickly for the curve she was negotiating, lost control and hit a barrier - She was travelling at 113km/hour in a 70 km speed zone - She had not heeded advice to slow down - Two passengers were injured, one very seriously - The accused pleaded guilty to dangerous driving causing bodily harm -Very remorseful - Enviable record of accomplishments despite absence of family support - At issue was whether a conditional sentence was appropriate where general deterrence and denunciation were the paramount considerations - The Alberta Provincial Court imposed a nine month conditional sentence - This was an unusual situation where incarceration was not required to emphasize denunciation and general deterrence.
