Summary:

The accused was charged with illegal production of marijuana and with illegal possession of marijuana for the purpose of trafficking.

The Court of Québec, Criminal and Penal Chamber, found the accused guilty. The accused appealed.

The Quebec Court of Appeal, Dalphond, J.A., dissenting, in a decision reported 437 N.R. 216, allowed the appeal and entered acquittals. The prosecution appealed.

The Supreme Court of Canada, Cromwell, J., dissenting, dismissed the appeal.

Attempts, conspiracies, accessories and parties - Parties to offences - Necessary intention or knowledge - The accused went away and left her land in the care of her adult son - When she came back, there was marijuana growing on her land - She told her son to remove it - She also declined to call the police because she did not want to "squeal" on her son - The accused was charged with illegal production of marijuana and with illegal possession of marijuana for the purpose of trafficking - The Supreme Court of Canada affirmed the accused's acquittal - The court stated that the evidence was insufficient to establish the required degree of certainty that the accused had acted, or failed to act, for the purpose of aiding any person to commit the crimes mentioned in the indictment, "even if that was clearly the result" - See paragraphs 1 to 3.
