Résumé:
The accused was convicted of possession of counterfeit money, uttering counterfeit money and failing to comply with undertaking to keep the peace and be of good behaviour (see 2006 NBPC 20).
The New Brunswick Provincial Court gave the accused credit of 12.5 months for the time spent on remand and imposed an additional eight months in jail (concurrent) for the counterfeiting offences and one month consecutive for the undertaking offence.

Punishments (sentence) - Conditional sentence - When available or appropriate - The 31 year old accused and three co-accused passed $2,100 in counterfeit $100 US bills during a 70 minute period at local businesses - 51 more counterfeit bills were found in their car - The accused was convicted of possession of counterfeit money, uttering counterfeit money and failing to comply with an undertaking to keep the peace and be of good behaviour - The accused was an immigrant - Recently married - Educated - Strong family support - Helped other immigrants to settle in Canada - No record - The co-accused pled guilty and received sentences ranging from eight months to 17.5 months - The New Brunswick Provincial Court gave the accused credit of 12.5 months for the time spent on remand and imposed an additional eight months in jail (concurrent) for the counterfeiting offences and one month consecutive for the undertaking breach - The crimes resulted from a sophisticated criminal enterprise - Counterfeiting was one of the fastest growing offences in Canada - The co-accused's sentences were highly probative - A sentence of time served together with a community based sentence as requested by the accused would not provide adequate denunciation of this offence given the need for general deterrence of counterfeiting.
