This case raised an issue as to the nature of the court's common law jurisdiction to impose a peace bond.

Recognizances and undertakings - Peace bonds and orders to keep the peace - Common law peace bonds - The Alberta Provincial Court discussed the common law jurisdiction to impose a peace bond and the nature of and test for granting such a bond - The court also discussed the duration, conditions and enforcement of the common law peace bond - The court opined that its common law jurisdiction to impose a peace bond was contingent upon information sufficient to justify a reasonable apprehension of a breach of the peace - The court noted that it was common practice in the jurisdiction to grant peace bonds without that information (i.e., upon consent) - The court outlined the procedure that should be followed in future cases where an accused chose to resolve charges by entering into a common law peace bond - See paragraphs 2 to 35.
