Summary:

The accused was convicted of an indictable offence. The Crown applied under s. 688 of the Criminal Code, R.S.C. 1970, c. C-34, for a finding that the accused was a dangerous offender and for a sentence to be imposed upon him accordingly. The Crown then applied under s. 691 for a direction that the accused attend before a psychiatrist for observation. The Crown requested an adjournment of the s. 688 application. The accused applied to have both of the Crown applications dismissed. The Northwest Territories Supreme Court allowed the s. 691 application, adjourned the s. 688 application and dismissed the application of the accused.

C-34, to have an accused examined by a psychiatrist before sentencing and the Crown requested an adjournment of a sentencing application - The accused submitted that his further detention for an adjournment was unwarranted and arbitrary - The Northwest Territories Supreme Court allowed the examination application under s. 691 and adjourned the sentencing application - The court held that the continued detention of the accused was pursuant to specific authorization and that the adjournment was reasonable and justifiable - See paragraphs 15, 16, 24.
