Summary:

An Information charged the applicant with drug related offences. At the preliminary inquiry, the applicant's counsel asked a police sergeant about the reasons why a particular undercover agent was no longer used. The Crown objected. The preliminary inquiry judge ruled against the question. The applicant brought a motion seeking orders for Crown disclosure about the undercover agent and remedies in default thereof. The applicant contended that the orders sought were outside of the preliminary inquiry judge's jurisdiction and that disclosure at this stage of the prosecution was vital to his ability to make full answer and defence.

The Alberta Court of Queen's Bench dismissed the motion, holding that it did not have jurisdiction to grant the orders sought.

Absent jurisdictional default by the preliminary inquiry judge, challenged by a correctly launched motion for certiorari, I cannot interfere in the manner suggested".
