Summary:

The accused pled guilty to one count of possessing child pornography and one count of making child pornography available, contrary to ss. 163.1(3) and (4) of the Criminal Code.

The Saskatchewan Provincial Court sentenced the accused to five years' incarceration on the charge of making available child pornography and a concurrent term of four years' incarceration on the charge of possession of child pornography. After credit for five months of remand time, the accused had four years and seven months left to serve. The court also imposed an order under s. 161 of the Criminal Code for 15 years, a DNA order and a lifetime Sex Offender Information Registration Act order.

Sentence - Manufacture, distribution or possession of obscene matter - Child pornography - The accused pled guilty to one count of possessing child pornography and one count of making child pornography available, contrary to ss. 163.1(3) and (4) of the Criminal Code - In 2005, the accused had been convicted of one count of possession of child pornography and sentenced to an 18 month conditional sentence - He began collecting child pornography again virtually as soon as his conditional sentence order expired - The accused was 58 years old - Except for the previous conviction for possession of child pornography, he had no criminal record - The Saskatchewan Provincial Court stated that two factors were significantly aggravating - The first was the size of the accused's collection of child pornography (the police determined that he had 80,393 images or videos) - The second, and more significant factor, was that this was a second offence - Particularly for a second-time offender, the principles of denunciation and deterrence had to be uppermost in the court's mind - The court sentenced the accused to five years' incarceration on the charge of making available child pornography and a concurrent term of four years' incarceration for the charge of possession of child pornography - After credit for five months of remand time, the accused had four years, seven months left to serve - While the Crown had sought an order under s. 161 of the Criminal Code for life, the court imposed an order under that section for 15 years - The accused would be in the range of 70 years old when the order ended - That would be sufficient for the protection of the public, and in particular children, for whose benefit s. 161 existed - The court also imposed a DNA order and a lifetime Sex Offender Information Registration Act order.
