Summary:
Taylor was convicted of entering on premises where entry was prohibited by notice, contrary to the Protection of Property Act, s. 3(1)(e). He appealed.
The summary conviction appeal court dismissed the appeal. Taylor appealed again.
The Nova Scotia Court of Appeal allowed the appeal and ordered a new trial.

Rights of accused - Right to make full answer and defence - Taylor was charged with entering on premises where entry was prohibited by notice, contrary to the Protection of Property Act, s. 3(1)(e) - At trial, he represented himself because his request for an adjournment to obtain a lawyer was denied - The trial judge opined that Taylor had sufficient time to obtain a lawyer as four months passed from the date of Taylor's not guilty plea to the trial - Taylor was convicted - The Nova Scotia Court of Appeal held that Taylor was not given the opportunity to conduct a full answer and defence - Particularly, the trial judge erred in law by failing to enquire into the reasonableness of Taylor's failure to obtain a lawyer - See paragraphs 1 to 23.
