Summary:

The accused pleaded guilty to operating an "over-snow vehicle" in Gros Morne National Park without the written permission of the Park's Superintendent, contrary to s. 41(1)(a) of the National Parks Highway Traffic Regulations, thereby committing an offence contrary to s. 24(2) of the Canada National Parks Act.

The Newfoundland and Labrador Provincial Court sentenced the accused to a $600 fine and 25 hours of volunteer work within the Park as supervised and arranged by the Superintendent.

Crown lands - National and provincial parks - Sentencing - The 26 year old accused pleaded guilty to operating an "over-snow vehicle" in Gros Morne National Park without the written permission of the Park's Superintendent, contrary to s. 41(1)(a) of the National Parks Highway Traffic Regulations, thereby committing an offence contrary to s. 24(2) of the Canada National Parks Act - The offence caused a risk of damage to animals which were vulnerable to habitat destruction - It was committed negligently rather than intentionally - The accused expressed remorse - The Newfoundland and Labrador Provincial Court sentenced the accused to a $600 fine and 25 hours of volunteer work within the Park as supervised and arranged by the Superintendent - The court refused to impose an order prohibiting the accused from operating an "over-snow vehicle" in the Park where what had occurred was an isolated incident, unlikely to be repeated - See paragraphs 34 to 38.
