Summary:
The accused was charged with possession of stolen goods contrary to s. 312 of the Criminal Code of Canada. The trial judge convicted the accused. The accused appealed to the Ontario Court of Appeal. The Ontario Court of Appeal allowed the appeal and quashed the conviction of the accused. The judgment of the Ontario Court of Appeal is set out below - see paragraphs 21 to 45. The accused appealed to the Supreme Court of Canada. The Supreme Court of Canada dismissed the appeal.

Possession of stolen goods - Essential elements - Possession or control - The 17 year old accused was invited by Hayes for a ride in a car which was recently stolen by Hayes - The accused was a passenger in the car when it was stopped by police - The Supreme Court of Canada affirmed the acquittal of the accused on a charge of possession of stolen goods - The court stated that s. 3(4) of the Criminal Code was inapplicable to prove possession by the accused because of the absence of any evidence to show that the accused had control of the car.
