Summary:

The accused was charged with driving while disqualified. The only issue raised by the defence was whether the accused had been arbitrarily detained contrary to s. 9 of the Charter.

The Saskatchewan Provincial Court found that the accused had not been arbitrarily detained. The accused was found guilty.

Detention and imprisonment - Detention - What constitutes arbitrary detention - A police officer received a complaint about the accused and he knew that she was disqualified from driving - The officer stopped a vehicle matching the description of the accused's vehicle in an area where he had been informed that she would likely be driving - The accused was charged with driving while disqualified - The Saskatchewan Provincial Court held that the police officer was acting in the lawful execution of his duties and the detention of the accused did not breach s. 9 of the Charter - The officer was legally entitled to stop the vehicle and ask for a driver's license and registration - He had a well-grounded suspicion of criminal activity - He also had the additional power granted to him by the Highway Traffic Act to detain and question about license and identity.
