Summary:
A youth was charged with theft of an automobile. On voir dire he raised several issues concerning the admissibility of a written confession, including infringement of his right to counsel where police neglected to inform him of the availability of legal aid and duty counsel.
The Alberta Provincial Court, Youth Division, acquitted the youth.

Young offenders - General principles - Procedure - Waiver of statutory rights - After admissible statements during investigation stages, a young offender signed a waiver under s. 56 of the Young Offenders Act and made a written confession - He signed part A of the waiver indicating that he had been advised of his rights under the Act - He indicated on parts B and C that he waived an adult's or lawyer's advice and presence - He only signed part C - The Alberta Provincial Court, Youth Division, held that the waiver was not tainted, was voluntary and complied with s. 56(4) of the Act - See paragraphs 6 to 11.
