Interpretation - Purpose of legislation - Duty to promote object of statute - Section 62 of the Fisheries Act made it an offence to obstruct a fisheries officer carrying out duties "under this Act" - The accused obstructed fisheries officers who were operating under regulations made pursuant to the Act - The accused argued at trial that since s. 62 was a penal section, it must be strictly construed so as to not include the enforcement of the Regulations - The trial judge agreed - The Crown appealed - The New Brunswick Court of Queen's Bench, Trial Division, allowed the appeal and ordered a new trial - The court held that the object of the Act was "to properly manage and control the commercial fish­ery" and it should give a "fair, large and liberal construction and interpretation" to the Act and Regulations - See paragraphs 13 and 14.
