Summary:

Vincent, a Huron Indian, was charged with illegally importing goods into Canada, con­trary to the Customs Act (Can.). The Ontario Court of Justice, Provincial Division (Masse, J.), found her guilty. She appealed. She argued that she had historical and treaty rights allowing her to import goods into Canada without paying duty or any other tax.

The Ontario Court of Appeal dismissed the appeal.

Treaties and proclamations - General - What constitutes a treaty - Vincent, a Huron Indian, was charged with illegally importing goods into Canada, contrary to the Customs Act (Can.) - In defence, Vincent pleaded, among others, that alleged promises made to the Indians when the Jay Treaty of 1794 was concluded between the British Crown and the United States constituted a treaty that 1) exempted the Indians from paying customs duties and 2) was guaranteed by s. 35 of the Constitution Act, 1982 - The Ontario Court of Appeal held that the alleged promises invoked by Vincent did not constitute a treaty for purposes of s. 35 of the Constitution Act, 1982 - See para­graphs 51 to 57.

Treaties and proclamations - General - Extinguishment - Vincent, a Huron Indian, was charged with illegally importing goods into Canada, contrary to the Customs Act (Can.) - In defence, Vincent pleaded, among others, that the Jay Treaty of 1794 between the British Crown and the United States exempted the Indians from paying customs duties and was guaranteed by s. 35 of the Constitution Act, 1982 - The Ontario Court of Appeal held: 1) the Jay Treaty was not a treaty for purposes of s. 35 of the Constitution Act, 1982, 2) even if were, it did not exempt the Indians from paying customs duties as claimed here and 3) any rights the Jay Treaty gave the Indians were extinguished by the time the Constitution Act, 1982, came into force - See paragraphs 1 to 37, 48 to 50.

General - Incorporation into domestic law - Vincent, a Huron Indian, was charged with illegally importing goods into Canada, contrary to the Customs Act (Can.) - In defence, Vincent pleaded, among others, that the Jay Treaty of 1794 between the British Crown and the United States exempted the Indians from paying customs duties - The Ontario Court of Appeal held that an international treaty such as the Jay Treaty did not confer rights justiciable before domestic courts unless the domestic legislator made these rights a part of its law - The Canadian legislator has not given the Indians the customs duty ex-emp­tion claimed here by Vincent - The Jay Treaty did not support the existence of such exemption - Vincent's defence was dismissed - See paragraphs 38 to 47.
