Summary:

A 17 year old youth was charged with four counts of breaking and entering, seven counts of breaching undertakings and four counts of breach of probation. He applied for judicial interim release.

The Newfoundland and Labrador Provincial Court denied interim release.

Compelling appearance, detention and release - Interim release or detention of accused pending trial or appeal - Detention necessary for protection of public (i.e., secondary ground) - A 17 year old youth was charged with four counts of breaking and entering (two commercial premises, government facility and private residence), seven counts of breaching undertakings and four counts of breach of probation - The Crown's case was strong, as the youth pleaded guilty to the substantive offences and stolen items were found in his possession - The youth had a record of 26 offences since July 7, 2008, including 16 convictions for breaching non-custodial dispositions (history of not complying with court orders) - The youth stated that this time he would abide by any release conditions, but offered no cogent reason why - The youth was estranged from his family, had addiction issues and was often homeless - Two prior stays at treatment facilities ended when the youth left the programs - The Newfoundland and Labrador Provincial Court denied the youth's application for judicial interim release - Since the latest offences occurred while the youth was subject to an undertaking, ss. 515(6) and 524(3) of the Criminal Code presumed continued detention unless the youth established on a balance of probabilities that his continued detention was not necessary on any of the three grounds stated in s. 515(10) - The court held that the youth's detention was necessary under s. 515(10)(b) (protection or safety of the public), given the likelihood that the youth, if released, would re-offend - The court opined that the youth's continued detention was also required under s. 515(10)(c) (confidence in the administration of justice).
