Summary:

The accused was charged with possession of cocaine and methylenedioxymethamphetamine for the purpose of trafficking contrary to s. 5(2) of the controlled Drugs and Substances Act and possession of a prohibited weapon (i.e., oleoresin capsicum) without a licence contrary to s. 91(2) of the Criminal Code. The accused claimed that his rights to be secure against unreasonable search and seizure and not to be arbitrarily detained as guaranteed by ss. 8 and 9 of the Charter were violated and that certain evidence should therefore be excluded under s. 24(2) of the Charter.

The Saskatchewan Provincial Court determined that the accused's Charter rights were not violated.
