Summary:

The infant plaintiff and his mother brought a negligence action against the defendant for damages for injuries suffered by the infant plaintiff when the defendant's motor vehicle, in which the infant plaintiff was a passenger, crashed into a retaining wall. The defendant admitted liability.

The Newfoundland Supreme Court, Trial Division assessed damages.
