Summary:

The plaintiffs sued the defendants alleging infection by HIV-contaminated blood products. The plaintiffs moved for leave to serve two expert reports that did not comply with the time requirements of rule 53.03(1). The defendant Bayer moved for an order directing the plaintiffs to provide a list of anticipated witnesses, together with a summary of their anticipated testimony.

The Ontario Court (General Division) granted the plaintiffs' motion and imposed terms. The court also granted Bayer's motion.
