Summary:

The plaintiff sued the defendant for trademark infringement. Both the plaintiff and the defendant applied for summary judgment.

The Federal Court dismissed the plaintiff's application for summary judgment, allowed the defendant's application for summary judgment and dismissed the plaintiff's action.

Trademarks, Names and Designs - Topic 1804

Trademarks - Infringement - Acts not constituting an infringement (incl. defences) - In May 1999, the plaintiff began using the line "You can get there from here" in its marketing campaign, giving public notice of its use in May 2002 (s. 9(1)(n)(ii) of the Trade-marks Act) - The defendant used the same line in promoting the sale of "New Canada Savings Bonds" in 2001 and continued its use after the publication - The plaintiff sued the defendant for trademark infringement - The Federal Court held that a public notice of adoption and use of a mark barred all other users in the future, but not any who established its adoption and use prior to publication of the notice - The issue was whether the defendant's use of the mark was for the same product before and after the publication - The court held that the annual series of bonds, differing in interest rates, were not new products.
