Summary:
The plaintiff RoyNat Inc. sought an order under rule 173 to strike out three paragraphs of the statement of defence filed by the defendants Terrance, Gregory and Randy Royer, on the grounds that they disclosed no reasonable defence and were scandalous, frivolous or vexatious.
The Saskatchewan Court of Queen's Bench ordered one of the paragraphs struck out.

Pleadings - Striking out pleadings - General principles - Queen's Bench Rule 173 provided that the court could strike out any pleading or part thereof on certain grounds, such as if it disclosed no reasonable cause of action or was scandalous, frivolous or vexatious - The Saskatchewan Court of Queen's Bench discussed when rule 173 should be employed (see paragraphs 19 to 42) and proposed a set of ten threshold questions to be used for determining the applicability of rule 173 (see paragraph 22).
