Summary:

Saskatchewan Wheat Pool and Grasslands Cattle Management, the applicants, had security interests in the Moultons' cattle. The Moultons transferred some of the cattle to the Smiths for payment for feed. The appli­cants applied for a declaration that they had priority to the cattle.

The Saskatchewan Court of Queen's Bench granted the declaration and ordered the Smiths to deliver the cattle to the applicants within 14 days, with a complete inventory of the cattle identifying each animal as well as any progeny and indicating their location. The court rejected the Smiths' claim for compensation for care of the cattle (agistment).

There was no such promise here. The respondents had possession of the animals as owners, and it was never contemplated that if they had to give them up as a result of their unjustified acts, they would be compensated for any loss they suffered for care and feeding." - See paragraph 41.

Security interests - Priorities - Effect of actual notice - The Moultons transferred some cattle to Harry and Craig Smith for payment for feed - Saskatchewan Wheat Pool (SWP) and Grasslands Cattle Man­agement (GCM) had security interests in the cattle - There was uncontradicted evidence that Harry Smith removed SWP ear tags from some of the cattle - The Saskatchewan Court of Queen's Bench held that the cattle were disposed of in the ordinary course of business, but that Harry Smith had notice of the security interests - The court held that any notice Harry Smith had of the security interests could not be imputed to Craig Smith where they were not in partnership - The court ordered the Smiths to deliver the cattle to SWP and GCM within 14 days - See paragraphs 20, 34, 35.
