Summary:

Poitras was employed by the City of Sas­katoon as a casual employee on a seasonal basis. The City did not rehire Poitras after he filed a grievance in which he claimed that he should be reclassified. The Saskatchewan Labour Relations Board determined that the City committed an unfair labour practice by not rehiring Poitras and ordered the City to compensate him for his monetary loss. Sec­tion 5(g) of the Trade Union Act provided that the Board could order monetary com­pensation where an employee was dis­charged, but the Act did not expressly pro­vide for monetary compensation with respect to rehiring. The Board concluded that it had power under s. 42 (the incidental powers provision) to order monetary compensation in circumstances amounting to failure to rehire. The City applied for judicial review.

The Saskatchewan Court of Queen's Bench, in a decision reported at 115 Sask.R. 198, quashed the compensation order, hold­ing that the Board did not have power under s. 42 to order monetary compensation. The Board appealed.

The Saskatchewan Court of Appeal, Vancise and Lane, JJ.A., dissenting, allowed the appeal, holding that Poitras had been discharged and the Board had the juris­dic­tion under s. 5(g) to order monetary com­pensation. The court did not decide the issue of whether the Board had jurisdiction under s. 42 to order monetary compensation where there was an unfair labour practice with respect to hiring.
