Summary:

The applicants applied under s. 137 of the Local Authorities Election Act with respect to the Gift Lake Metis Settlement election held in October 2013. They alleged that there were serious irregularities concerning the election. In particular, the applicants complained that Jason Anderson was an ineligible candidate but he was permitted to run and was elected, and that ineligible voters were allowed to vote. The respondents acknowledged that an ineligible candidate ran in the election (Jason Anderson, who resigned and was re-elected in a by-election), but denied that there were irregularities with regard to voting.

The Alberta Court of Queen's Bench set aside the election of three of five councillors, namely Ronnie Anderson, Chris Lamouche and Sherry Anderson. As a result, council was left without a quorum, which had to be three councillors under s. 38(1) of the Metis Settlements Act. A new general election was more than two years away. The court ordered a new election to be held to fill the three vacancies created by its decision.
