Summary:

Shell Canada applied for leave to appeal an order of the Saskatchewan Surface Rights Arbitration Board and for an order extending the time to make the application, if necessary. A judge of the Saskatchewan Court of Appeal, in Chambers, held that the application for leave was made within the prescribed time limit and thus no extension of time was necessary. The judge granted leave to appeal on certain questions of law (see paragraph 9).

Judicial review - Statutory appeal - Commencement of time in which to apply for leave to appeal - Affected persons may, with leave, appeal decisions of the Surface Rights Arbitration Board - The application for leave must be filed and served within 30 days after the date upon which the impugned decision is made, likewise an application to extend the time for applying - The Saskatchewan Court of Appeal held that an order of the Board is "made" on the date the decision is pronounced in open court, and hence the time for applying for leave (or an extension of time for applying) commences to run from that date - If the decision is not given in open court, then the time runs from the date the parties are notified of the decision.
