Summary:

This case arose out of an assessment of tax against a taxpayer by the Ontario Mining Commissioner. The assessment was made after lengthy proceedings before the Mining Commissioner. The taxpayer appealed the assessment to the Ontario Court of Appeal, which allowed the appeal in a judgment reported at 25 D.L.R.(3d) 515.

On appeal to the Supreme Court of Canada the Supreme Court of Canada dismissed the appeal at the hearing without hearing the taxpayer. On the question of costs the Supreme Court of Canada held that s. 10(6) of the Mining Tax Act, R.S.O. 1960, c. 242, by implication forbade the award of costs against the Crown in proceedings before the Mining Commissioner. The Supreme Court of Canada held that the discretion of the Supreme Court of Canada in costs under s. 49 of the Supreme Court Act, R.S.C. 1970, c. S-19, should not be exercised to award costs against the Crown in proceedings before the Mining Commissioner.

Laskin, C.J.C., dissenting, in the Supreme Court of Canada, was of the opinion that s. 10(6) did not restrict the right of a higher court to award costs against the Crown in the proceedings before the Mining Commissioner - see paragraphs 1 to 10 and 19. In any event Laskin, C.J.C., was of the opinion that once the matter came before the Supreme Court of Canada the Court's power to award costs at any of the levels of litigation was authorized by s. 49 of the Supreme Court Act - see paragraphs 11 to 20.
